FORT MYERS, Fla. – January 4, 2018 -Florida Bar Board Certified Wills, Trusts and Estates Attorneys Craig R. Hersch and Michael B. Hill, partners with Sheppard, Brett, Stewart, Hersch, Kinsey & Hill, P.A. will host free Florida Residency and Estate Planning Workshops from 2 to 4 p.m. on Thursday, February 1 at Faith United Methodist Church, 15690 McGregor Blvd. in Fort Myers and again on Friday, February 2 at Sanibel Community House, 2173 Periwinkle Way on Sanibel Island. Lee County Bar Association celebrates successful year

The Lee County Bar Association (LCBA) recently celebrated another successful year with its holiday party at the Edison & Ford Winter Estates on Thursday, Dec. 7. Party-goers enjoyed great music and food as they mingled and recapped the great work the bar association did over the course of 2017. The highlight of the evening occurred when members reflected on the abundant acts of kindness performed through #KindLee.

LCBA President Kelly Fayer wrapped up her year in office and her #KindLee initiative by presenting a check for $500 to the winner of the year-long social media campaign, nine-year-old Christian Erwin. The check will go to Christian’s charity of choice, or so he can perform acts of kindness in 2018. #KindLee was used to spotlight and celebrate kind acts performed throughout Southwest Florida. Residents were invited to post their stories with a photo on Instagram, Twitter, Google+, Pinterest and Facebook and include the hashtag #KindLee.

Fayer said, “We knew that this community did plenty of great things and the response we had with the #KindLee initiative this year is proof that the people of Southwest Florida are amazing. Christian’s efforts in this campaign were exemplary and we thank him and everyone else that took part. Christian will donate the funds to a charity of his choice or use the funds to perform acts of kindness in 2018.”

Additionally, Fayer presented the Lee County Legal Aid Society with two checks. The first check of $19,200 was a portion of the proceeds raised at the annual LCBA golf tournament held in May 2017. The other check, in the amount of $3,000, was a grant from the LCBA Foundation.

Jury orders FPL to pay grieving mother of Fort Myer’s teen nearly $24 million

Aloia, Roland, Lubell & Morgan, PLLC (ARLM)—a leading, SWFL personal injury, business litigation, civil rights, family law, and real estate law firm is proud to announce that ARLM partners, Ty Roland and Evan Lubell, won a $23.75 million settlement in the wrongful death case of Tricia Dominguez versus Florida Power & Light. “This is one of the largest verdicts in Lee County History,” says, attorney Frank Aloia.

In 2008, FPL’s own inspectors warned the company that bamboo near the Dominguez home was too close to power lines and should be removed. Three years later, 15-year-old Justin Dominguez was playing with other children at a neighbor’s home when the bamboo stalk he climbed struck the high-voltage power lines and he sustained catastrophic injuries. He died two weeks later in a hospital after he was declared brain dead and removed from a ventilator.

“FPL had more than ten opportunities, since 2008, to eliminate the danger to the children living adjacent to this 13,000 volt power line, and failed to act each and every time. They broke the law. They broke their own rules. They blamed a boy for climbing a tree, instead of apologizing and trying to stop it from happening again,” said Ty Roland. In addition, Evan Lubell said, “The Jury had the rare opportunity to see in the light of day the behind-the-scenes decision-making that multi-billion-dollar companies like FPL make when their failures are challenged by regular people.”

ARLM partners, Ty Roland and Evan Lubell, showed the jury an FPL work order to remove the bamboo at that exact address from three years before the boy died. FPL knew for years that the highly conductive bamboo posed a serious threat to the people living in the area, and yet the Florida utility did nothing to address the danger. A six-man jury found for Mrs. Dominguez and awarded her $8.75 million for pain and suffering for the loss of her first-born son. The jury took the further step to award Mrs. Dominquez punitive damages of $15.0 million for FPL’s gross negligence. The purpose of the punitive damages is to punish FPL for their gross incompetence and to prevent this from ever happening again.

The impact of this case is more than just monetary.  “This verdict will save lives,” said Ty Roland. The bamboo near the power lines was finally removed, nine years after its discovery as a hazard, and six years after this teen’s death. Roland adds, “We just received word that another clump of bamboo was removed just yesterday off of McGregor. Hopefully, this verdict will serve as a warning and prevention of any future deaths in relation to overgrown bamboo near power lines.”

Waterside Shops to hold Sip & Shop event to support Legal Aid

Waterside Shops in Naples will conduct a holiday weekend ‘Sip & Shop’ event spanning Black Friday, November 24th through Sunday, November 26th, donating all proceeds from its famous Bloody Mary Bar to Legal Aid Service of Collier County.

In addition to the Bloody Mary Bar, the event will include live entertainment and an information station where patrons can learn more about the vital free civil legal services provided by Legal Aid. This is the second year that the Sip & Shop event has been held on the Thanksgiving holiday weekend to benefit Legal Aid. Last year, Waterside Shops presented Legal Aid with a donation in the amount of $1,000, with patrons generously donating more than $500 in additional funds.

Waterside Shops is a landmark shopping and dining destination, with stores featuring some of the finest names in luxury retail and fashion, all contained in a unique and lushly landscaped setting. Legal Aid Service of Collier County provides free civil legal services to Collier County residents who face life-changing legal matters who cannot afford counsel. Legal Aid handles over 3,500 cases annually, assisting some of the most vulnerable members of our community. Legal Aid’s clients include victims of domestic violence, children who have been abused, neglected or abandoned, families facing foreclosure or eviction, children with special educational needs, and seniors, Veterans and the disabled seeking medical and income benefits.
